Terms of Service

1. Introduction

Welcome to WickScout Finance LLC (“WickScout,” “we,” “us,” or “our”). These Terms of Service (“Terms” or “Agreement”) govern your access to and use of our application (the “App”) and related services that identify, consolidate, or convert residual crypto token balances (“Dust”) from your Phantom Wallet or other supported Solana wallets (collectively, the “Services”).

By connecting your wallet and using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Definitions

• “User,” “you,” or “your” means any person who uses the Services.
• “Wallet” means your self-custodied digital wallet, such as Phantom Wallet, compatible with the Solana blockchain.
• “Dust” means small or fractional token balances remaining in your Wallet that the App helps aggregate, manage, or convert.
• “Supported Network” means the Solana blockchain or any network supported by WickScout.
• “Third-Party Services” means external blockchain networks, smart contracts, wallet providers, or services not controlled by WickScout.

3. Eligibility and Restrictions

You must:

• Be at least 18 years old (or the legal age of majority in your jurisdiction).
• Have the authority to enter into this Agreement.
• Use the Services only for lawful purposes and in compliance with all applicable laws, including anti-money laundering (AML), counter-terrorist financing (CTF), tax, and securities regulations.

You must not:

• Use the Services for illegal activity or to conceal illicit funds.
• Attempt to reverse-engineer, hack, or misuse the App.
• Impersonate another person or misrepresent your Wallet ownership.
• Use the App in any manner that could damage the Solana network or WickScout systems.

4. Connecting Your Wallet

When you connect your Phantom Wallet, you authorize the App to:

• View your public wallet address and token balances;
• Identify Dust and initiate transactions only after your explicit approval.

You retain full control of your private keys. WickScout never stores or has access to your private key, recovery phrase, or Wallet contents. You are solely responsible for securing your Wallet and verifying all transactions.

5. Blockchain Transactions

• Transactions on the Solana blockchain are irreversible once confirmed.
• You acknowledge that network fees (gas) are required for every blockchain action.
• WickScout does not guarantee that a transaction will execute successfully or in a specific timeframe.
• WickScout is not responsible for network errors, smart contract failures, forks, or losses caused by third-party platforms.

6. Fees and Payments

• Some Services may include a conversion or processing fee, which will be clearly displayed before you confirm a transaction.
• Fees are non-refundable once processed.
• You are responsible for any blockchain network fees (gas/transaction fees).
• WickScout reserves the right to modify fees at any time. Continued use of the Services after changes constitutes acceptance of the new fees.

7. Risk Disclosure

By using the Services, you acknowledge that:

• All blockchain activity involves significant financial and technical risk.
• Tokens may lose value or become inaccessible due to smart contract issues or network instability.
• You are not purchasing, trading, or investing through WickScout. The App simply facilitates wallet-level dust management.
• WickScout does not provide financial, tax, or investment advice.

Use the Services at your own risk.

8. Intellectual Property

All content, branding, design, code, and other intellectual property within the App are the property of WickScout Finance LLC. You may not copy, modify, reproduce, distribute, or exploit the App or any related content without express written permission.

Aggregate or anonymized data collected from App use may be analyzed to improve services, but WickScout never sells or distributes personal wallet data.

9. Limitation of Liability

The Services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law:

• WickScout makes no warranties—express or implied—about the reliability, security, or accuracy of the App or Services.
• WickScout is not liable for any losses resulting from:
  • Blockchain network failures or congestion;
  • Bugs, exploits, or contract vulnerabilities;
  • Incorrect Wallet setup, seed phrase loss, or unauthorized access;
  • Any price volatility or token devaluation.

Maximum Liability:In no event will WickScout’s total liability exceed the lesser of $100 USD or the total fees you paid in the previous 12 months.

10. Indemnification

You agree to indemnify and hold harmless WickScout Finance LLC, its officers, employees, and partners against any claims, damages, or losses arising from:

• Your breach of these Terms;
• Your misuse of the Services;
• Any transaction or activity conducted through your Wallet.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflicts of law principles.

Any dispute arising from or related to these Terms shall be resolved by binding arbitration in Delaware, under the rules of the American Arbitration Association (AAA). You waive any right to participate in a class action or jury trial.

If any provision is found unenforceable, the remaining provisions remain in effect.

12. Termination

WickScout may suspend or terminate your access to the Services at any time for:

• Violations of these Terms;
• Suspected fraudulent or illegal activity; or
• Technical or regulatory reasons.

Upon termination, you must disconnect your Wallet and cease using the App. Sections 7–11 survive termination.

13. Modifications

We may revise these Terms from time to time. Updated Terms will be posted in the App or on our website with a new “Last Revised” date. By continuing to use the Services after the effective date, you agree to the updated Terms.

15. Acknowledgment

By connecting your Wallet and using the Services, you acknowledge that you have read, understood, and agreed to these Terms of Service.
